Ask a Bozeman seller what they have to tell you about their house, and the honest answer is: only what they already know. That sounds obvious until you sit with it. Montana's disclosure law does not require anyone to go looking for problems. It requires them to report what they've found, if they've bothered to look at all.

That gap, between what the law makes mandatory and what a buyer actually needs to know, is where Bozeman deals get interesting. It shows up in three places every time: the gas under the slab, the system in the yard, and the soil holding both of them up.

The Warning Is Mandatory. The Test Is Not.

Every Montana home sale includes a radon disclosure statement, required by the Montana Radon Control Act. Sellers have to hand buyers a specific warning, word for word, before or at the time of an offer:

"RADON GAS: RADON IS A NATURALLY OCCURRING RADIOACTIVE GAS THAT, WHEN IT HAS ACCUMULATED IN A BUILDING IN SUFFICIENT QUANTITIES, MAY PRESENT HEALTH RISKS TO PERSONS WHO ARE EXPOSED TO IT OVER TIME. LEVELS OF RADON THAT EXCEED FEDERAL GUIDELINES HAVE BEEN FOUND IN BUILDINGS IN MONTANA. ADDITIONAL INFORMATION REGARDING RADON AND RADON TESTING MAY BE OBTAINED FROM YOUR COUNTY OR STATE PUBLIC HEALTH UNIT."

That's the whole requirement. If the seller has never tested the house, that boilerplate paragraph is the entire disclosure. There's no obligation to test before listing, no state mandate that new construction include a mitigation system, and no penalty for simply not knowing. The same logic runs through Montana's broader seller disclosure statute, which requires sellers to report material defects they actually know about, not defects a proper investigation would reveal. A seller who never asked the question never has to answer it.

For a buyer, that means the warning label on the form tells you almost nothing about the actual air in the actual house. It tells you the law exists. It doesn't tell you the number.

Why The Gap Matters More Here Than Most Places

Bozeman zip codes sit inside the EPA's highest radon potential zone, and the numbers back up why that classification exists. Montana's statewide average indoor radon level runs close to double the EPA's own action threshold of 4.0 pCi/L, and several times higher than the national average. In practice, here's what actually happens during a transaction. If the result comes back at or above 4 pCi/L, the Montana DEQ recommends the issue be addressed as part of the transaction, and most buyers ask for a confirmatory second test before deciding how to proceed. Fixing it isn't dramatic. A sub-slab depressurization system is the most common fix, the DEQ notes that repair costs are typically in line with other routine home repairs like a water heater replacement, and the fan itself runs on a modest amount of electricity, on the order of 876 kWh a year. None of that is a reason to walk from a house. It is a reason to test before you assume the disclosure form told you what you needed to know.

The Same Blind Spot Runs Underground

Move outside the house and the pattern repeats. A meaningful share of Gallatin County, especially the acreage and ranch-style properties outside city limits, runs on private septic systems and wells rather than municipal water and sewer. Septic permits are administered through the Gallatin City-County Health Department, and the disclosure standard for these systems is the same "actual knowledge" bar that governs radon. If a seller never had the tank pumped, never had the drainfield inspected, and never asked a question about it, there's nothing hiding to disclose. The system could be functioning perfectly, or it could be years past due for attention, and the paperwork looks identical either way.

The dollar gap between the two outcomes is real. Routine septic maintenance, tank pumping and a basic check, runs roughly $200 to $400 every three to five years according to guidance from the Gallatin River Task Force, a local nonprofit focused on watershed health. Replacing a failed system runs $8,000 to $20,000. That's not a rounding error in a purchase negotiation, and it's exactly the kind of cost that surfaces only if someone actually looks.

There's a subdivision-specific wrinkle worth knowing if your search stretches into the wider Gallatin Valley. Gallatin River Ranch, a subdivision just north of Manhattan, was platted years ago into 20-acre parcels specifically to sit under the threshold that triggers state subdivision review. The land was later resurveyed, and about half of those parcels came back under 20 acres. Any owner on one of those smaller parcels who wants to build now has to go through a full, expensive state subdivision review before they can even apply for a septic permit, a detail documented by the licensed engineer who handles septic design work in the area. It's the kind of fact that never shows up on a listing sheet and only surfaces when someone tries to pull a permit.

The Ground Itself Moves

The third blind spot isn't underground so much as it is seasonal. Bozeman sits on bentonite clay soil that expands when it's wet and shrinks when it dries, and layered on top of that is a real freeze-thaw cycle every winter. Foundation contractors serving the area describe this combination as the primary driver of cracked slabs, bowing basement walls, and doors and windows that suddenly stick or won't latch.
